Maike Bergervoet and Jeroen Starreveld of Spigt Dutch Caribbean (Attorneys & Tax Advisers) have written an article on the Curacao Private Foundation, the Curacao Trust and the Dutch Private Foundation, which is published in Trust & Trustees (2013, Volume 19, Number 6, Pp. 577-583).
This article contains an analysis of the Curaçao Private Foundation, the Curaçao Trust, and the Dutch Private Foundation from a privacy perspective. It compares and contrasts which information is publicly available with a view to the above entities and also which information needs to be made available in case foreign tax authorities submit a request for information.
Maike Bergervoet is a partner who practices in the fields of corporate and financial law. She holds a notarial and Dutch law degree from the Radboud University Nijmegen, the Netherlands. Recent transactions include the implementation of privacy and asset protection structures (including the use of the Dutch Caribbean Cooperative and Dutch Caribbean Private Foundation), advice and implementation of holding structures involving ultimate beneficial owners (UBOs) in Latin America with activities in Europe, and tax litigation to prevent fishing expeditions under tax information exchange agreements.
