Abstract
‘The 10 October 2010 marks the date on which the Netherlands Antilles ceased to exist. Two new countries were born, Curacao and Sint Maarten. The three remaining islands, the BES islands, have become part of the Netherlands. The article discusses the new BES islands tax regime which is characterized by simplicity and a shift from direct to indirect taxes. Real business is fostered, but anti-abuse measures were introduced for typical offshore activities. A BES corporation may benefit from the Dutch double tax treaties network. However, a distribution tax at a rate of 5 per cent also applies to Private Foundations.’
