As of July 1, 2017, new "Directive Relational Violance" will apply

The " Directive Relational Violance" is as of July 1, 2017 in force for Curaçao, Saint Maarten and Bonaire, Sint Eustatius and Saba.
 
This directive replaces the "Violence within the relational atmosphere of Curaçao" from 2006 and the "domestic violence and honor-related violence of the Netherlands" (2010A010).
 
The instruction is conform Article 5 paragraph 4 of the Public Prosecutor's Office issued by the Attorney-General of Curaçao, Sint Maarten and Bonaire, Saint Eustatius and Saba.
 
The term "relational violence" makes it clear that violence does not occur only within a home.
It is about violence committed by someone within the family or amorous relationship of the victim, regardless of the place where violence is committed.
 
The purpose of this directive is to achieve uniformity and to make more effective and efficient action by the police and the Public Prosecutor in response to relational violence.
 
When combating relational violence, it is very important to prevent recurrence. Assistance to the victim and victim should be used as early as possible.
 
Relational violence is one of the priorities of the Public Prosecutor's Office in 2017. Violence within the relational atmosphere is a problem which unfortunately occurs on a large scale, but remains invisible. The Public Prosecutor wants to protect this vulnerable group of victims. 
 
This instruction lays down rules on the detection and prosecution of relational violence. In addition, boundary conditions are formulated for the fulfillment of local cooperation between the police and the Public Prosecutor and other partners such as the Probation Office (Reclassering) on Curaçao, Sint Maarten and Bonaire, Sint Eustatius and Saba.
 
The OM realizes that the directive on Sint Maarten initially has limited employability because ‘victim aid’ (Slachtofferhulp) is in the process of being established. For this reason, the Public Prosecutor's Office is pleased to see that victim aid is soon received on Sint Maarten and is happy to assist.

Per 1 juli 2017 nieuwe “Aanwijzing Relationeel Geweld” van kracht
 
Per 1 juli 2017 is de “Aanwijzing Relationeel Geweld” van kracht binnen Curaçao, Sint Maarten en Bonaire, Sint Eustatius en Saba. Deze richtlijn vervangt de “richtlijn geweld binnen de relationele sfeer Curaçao” uit 2006 en de “richtlijn huiselijk geweld en eergerelateerd geweld van het OM Nederland” (2010A010). Het betreft een richtlijn in de zin van artikel 5 lid 4 Rijkswet Openbaar Ministeries uitgevaardigd door de Procureur-Generaal van Curaçao, Sint Maarten en Bonaire, Sint Eustatius en Saba.
 
Met de term “relationeel geweld” wordt duidelijk gemaakt dat het geweld niet alleen plaatsvindt binnen een huis. Het gaat namelijk om geweld dat door iemand binnen de familie- of amoureuze relatie van het slachtoffer is/wordt gepleegd, ongeacht de plaats waar het geweld wordt gepleegd.
 
Het doel van deze aanwijzing is dat er uniformiteit ontstaat en een effectiever en efficiënter optreden van politie en Openbaar Ministerie in reactie op relationeel geweld.
 
Bij het bestrijden van relationeel geweld is het van groot belang om recidive te voorkomen.
Hulpverlening aan dader en slachtoffer dienen in een zo vroeg mogelijke stadium te worden ingezet.
 
Relationeel geweld is namelijk een van de prioriteiten van het Openbaar Ministerie in 2017.
Geweld binnen de relationele sfeer is een probleem dat helaas op grote schaal voorkomt, maar veelal onzichtbaar blijft. Het Openbaar Ministerie wil deze kwetsbare groep slachtoffers beschermen.
 
Deze aanwijzing stelt regels over de opsporing en vervolging van relationeel geweld.
Daarbij worden randvoorwaarden geformuleerd voor de invulling van lokale samenwerking tussen politie en Openbaar Ministerie en andere partners zoals de reclassering op Curaçao, Sint Maarten en Bonaire, Sint Eustatius en Saba. Het OM realiseert zich dat de aanwijzing op Sint Maarten in eerste instantie beperkte inzetbaarheid heeft, omdat de slachtofferhulp in oprichting is. Om die reden ziet het Openbaar Ministerie graag dat Slachtofferhulp spoedig zijn vorm krijgt op Sint Maarten en werkt daar graag aan mee.
