Handling imminent of Dispute Regulation law

THE HAGUE--The law proposal to establish a Dispute Regulation for the Kingdom (“geschillenreging”) is slated for handling by the Kingdom Council of Ministers before the end of 2016.
 
Dutch Minister of Home Affairs and Kingdom Relations Ronald Plasterk stated this in a letter to the Second Chamber of the Dutch Parliament on Tuesday. The Permanent Committee for Kingdom Relations of the Second Chamber last week asked for an update regarding the submitting of a law proposal to establish the Dispute Regulation along with a time indication.
 
Plasterk explained that the Dutch Government aimed to handle a Kingdom Law proposal to establish a dispute regulation as stated in article 12a of the Kingdom Charter in the Kingdom Council of Ministers before the end of this year.
 
Following the approval by the Kingdom Government the law proposal will be sent to the Council of State of the Kingdom. The Kingdom Law proposal will probably be submitted to the Second Chamber early 2017 depending on the moment of the receipt of the advice, stated Plasterk.
 
The establishing of a Dispute Regulation where countries in the Kingdom can take their differences of interpretation is a fervent wish of especially Aruba, Curaçao and St. Maarten. The Second Chamber has expressed its support for the establishing of said regulation.
 
However, the Dutch Caribbean countries and the Netherlands so far have been unable to reach a joint decision on the scope and the authority of the Dispute Regulation, as well as which entity would handle complaints filed under the Dispute Regulation.
The Dispute Regulation has been a recurring agenda point at the meetings of the Inter-Parliamentary Consultation for the Kingdom IPKO and the Kingdom Conferences.
