Agreement on Integrity Chamber

THE HAGUE—The Governments of St. Maarten and the Netherlands over the weekend reached an agreement on the establishing of an independent Integrity Chamber for St. Maarten and the strengthening of the island’s law enforcement sector.
 
St. Maarten’s Justice Minister Dennis Richardson and Dutch Minister of Home Affairs and Kingdom Relations Ronald Plasterk signed a protocol in The Hague on Saturday, which effectively forces the St. Maarten Parliament to approve the National Integrity Chamber Ordinance by the end of this month and no later than July 31.
 
The protocol on the establishing, format, functioning and cost of the Integrity Chamber is based on a mutual regulation and cooperation defined in article 38 of the Kingdom Charter. As a result, the imposing of a General Measure of the Kingdom Government (“Algemene Maatregel van Rijksbestuur”AMvRB) to establish the Integrity Chamber, currently at the Council of State for advice, is off the books for now.
 
The protocol not only restricts the authority of the St. Maarten Parliament, but also that of the St. Maarten Council of Ministers. The latter may not cooperate to any changes to the National Integrity Chamber Ordinance without first consulting the Dutch Government.
 
The cost of the Integrity Chamber will be carried by the Ministry of Home Affairs and Kingdom Relations BZK and the St. Maarten Government. The protocol states that the Netherlands will appoint a quarter master before July 1.
 
The establishing of the Integrity Chamber is in line with the recommendations of the integrity audits that were completed last year.
 
The Integrity Chamber will have the independent authority to to investigate possible integrity violations, report to the Public Prosecutor’s Office, give advice and recommendations. The Integrity Chamber will report to the St. Maarten Government and Parliament, as well as the Kingdom Council of Ministers.
 
Where it pertains to the law enforcement sector, St. Maarten and the Netherlands agreed on the strengthening of the St. Maarten Police Force, the National Detectives (Landsrecherche), the Kingdom Detective Cooperation Team RST, the Public Prosecutor’s Office and the Royal Netherlands Marechaussee.
 
The strengthening concentrates on combating of high impact crimes, border transgressing and undermining crime, human trafficking and trade. There will be special attention to strengthen the cooperation between the local law enforcement entities.
 
A steering group will be established under the responsibility of the St. Maarten Justice Minister to guide and supervise the process to strengthen the St. Maarten Police Force. The Netherlands will make experts and capacity available for the process. The participation of the At. Maarten Police Force in the RST will be intensified. Also, the cooperation with French St. Martin, surrounding countries and the United States will be intensified.  
 
Richardson and Plasterk were both “very satisfied” with the fact that the countries together arrived at “this important agreement” it was stated in a press release of the BZK Ministry Tuesday morning. 
 
 
 
Akkoord over integriteitproblematiek Sint Maarten
 
Sint Maarten en Nederland hebben een akkoord bereikt over de integriteitproblematiek op Sint Maarten: het eiland krijgt een onafhankelijke Integriteitkamer. Ministers Dennis Richardson (Sint Maarten, Justitie) en Ronald Plasterk (Nederland, Binnenlandse Zaken en Koninkrijksrelaties) hebben zaterdag 23 mei het protocol getekend waarin de afspraken vastgelegd zijn.
 
Ook zijn er afspraken gemaakt over de bijstand voor en versterking van de rechtshandhaving op Sint Maarten, om de bestrijding van onder meer geweld, overvallen en mensenhandel te versterken. Richardson en Plasterk zeggen beiden zeer tevreden te zijn dat de landen gezamenlijk tot dit belangrijke akkoord zijn gekomen.
 
Met de instelling van de Integriteitkamer wordt uitvoering gegeven aan de aanbevelingen van de vorig jaar gehouden integriteitonderzoeken. Deze kamer krijgt zelfstandige bevoegdheden voor het geven van advies en het doen van aanbevelingen. Ook mag de kamer onderzoek instellen en aangifte doen. De Integriteitkamer wordt verankerd in een Landsverordening, en doet zowel verslag aan de regering en Staten van Sint Maarten als aan de Rijksministerraad.
 
De versterking van de rechtsbijstand vindt plaats bij zowel het politiekorps Sint Maarten, de Landsrecherche, het Recherchesamenwerkingsteam als bij het Openbaar Ministerie en de Koninklijke Marechaussee. De versterking is in het bijzonder gericht op bestrijding van high impact crimes, grensoverschrijdende en ondermijnende criminaliteit, mensenhandel en smokkel.
