Frank Kunneman of Law firm VanEps Kunneman VanDoorne will give a presentation on insurance fraud at the IBA Annual Conference, which is to be held in Buenos Aires.
At the upcoming annual conference of the International Bar Association, which is to be held from 12-17 October 2008 in Buenos Aires, Frank Kunneman, Managing Partner of the Netherlands Antilles law firm VanEps Kunneman VanDoorne, will give a presentation. The title of his presentation is “Tilkema cut his thumb off. What about the insurance company? Legal aspects of insurance fraud in the Netherlands Antilles and the Netherlands”.
Frank Kunneman will discuss the high costs of insurance frauds. Insurance frauds occurs in at least three different stages: when applying for an insurance policy, when the insured fact takes place and when the event is being reported. In case of alleged fraud, in the Netherlands and the Netherlands Antilles the burden of proof lies with the insurance company. Careful wording of the application form is mandatory, since concealment on the side of the insured is no cause for nullification of the policy by itself. For the insurance company it is often easier to prove recklessness or a severe fault, than to prove fraud. According to the Supreme Court it is sufficient when the insurance company proves that a normal person would have known that a reasonable chance exists that a certain behavior would lead to damages.
