Fourth DCA Opinion over Facebook friendship

UNITES STATES - Having a prosecutor as a Facebook friend got a Broward circuit judge bumped from a criminal case, and other judges are taking note.

 

Circuit Judge Andrew Siegel was asked by Fort Lauderdale criminal defense attorney Denzle Latty to recuse himself because Siegel had friended the assistant state attorney in his court.
 
When Siegel ruled the motion as "legally insufficient," Latty went to the Fourth District Court of Appeal with a petition for writ of prohibition. A three-judge panel unanimously granted the petition Sept. 5 in an unsigned opinion.
 
The panel pointed to a 2009 opinion of the state Judicial Ethics Advisory Committee in supporting the writ. The panel concluded that a judge's listing of a lawyer as a 'friend' on the judge's social networking page, where both parties can be identified, "would violate Florida Code of Judicial Conduct Canon 2B."
