Daal considers new lawsuit

WILLEMSTAD — As of today Harold Daal is no longer head of the department Public Affairs (Kranshi). Minister Carlos Monk (Administration, Planning and Service, PS) informed Daal in writing this week.

Daal is honorably discharged from office and is to report today for a new position at the department Human Resources Organization Development and IT (HROOIT). In the letter from Monk, Daal is informed that he will be entrusted with the investigation into the education gap within the government apparatus for a period of three months. In addition to this position, he will receive a salary increase of approximately 800 guilders, said his attorney Roy Bottse, referring to a national order that Monk had sent to his client. Bottse views this salary increase as a douceur for the fact that his client is to leave Kranshi.

This morning Bottse said he found the entire state of affairs very strange. “My client is honorably discharged from office as head of the department but the reason is a devastating report on his functioning at Kranshi. Now he’s placed at the disposal of the government where he is offered a vague position, and this is all due to a protest from officials who are politically motivated.” The lawyer said that his client, Daal, always done his utmost to improve the functioning of his subordinates from the moment he joined Kranshi. In this respect, he refers to numerous investigations at the government service, from which it appeared through the years that the work ethic of the Kranshi-personnel left much to be desired. “Daal had been trying to tackle this but they hadn’t thanked him for this.”
 
Bottse couldn’t indicate this morning whether his client would answer the government’s call to report at HROOIT or if he would accept the offer. Bottse said he and Daal were studying the minister’s letter and it’s most likely they’ll take the matter to court to obtain clarity on the state of affairs. “Fact remains that my client was kept from performing his duties after he won a lawsuit against the minister in January this year.”

Daal is eervol ontheven van zijn functie en moet zich vandaag melden voor een nieuwe functie bij de afdeling van Human Resources Organisatie Ontwikkeling en IT (HROOIT).

In de brief van Monk krijgt Daal te horen dat hij voor de periode van drie maanden belast zal worden met het onderzoek naar de opleidingskloof binnen het overheidsapparaat. Naast deze functie krijgt hij ook een salarisverhoging van zo’n 800 gulden, aldus zijn advocaat Roy Bottse, verwijzend naar een landsbesluit dat Monk naar zijn cliënt heeft gestuurd. Bottse beschouwt deze salarisverhoging als een douceurtje voor het feit dat hij bij Kranshi wegmoet.
 
Bottse verklaarde vanochtend de hele gang van zaken heel vreemd te vinden. “Mijn cliënt wordt eervol ontheven van zijn functie als diensthoofd. Maar de aanleiding hiervoor is een vernietigend rapport over zijn functioneren bij Kranshi. En nu wordt hij ter beschikking gesteld van de regering en krijgt hij een vage functie aangeboden. En dit allemaal vanwege een protest van ambtenaren, dat politiek gemotiveerd is.” De advocaat stelde dat zijn cliënt, Daal, sinds zijn aantreden bij Kranshi, altijd zijn best heeft gedaan om het functioneren van zijn ondergeschikten te verbeteren. In dit verband verwijst hij naar naar tal van onderzoeken bij de overheidsdienst, waarbij door de jaren heen zou zijn gebleken dat er heel wat aan te merken is op de arbeidsethos van het Kranshi-personeel. “Dit is wat Daal heeft geprobeerd aan te pakken, maar dat werd hem niet in dank afgenomen.”
 
Bottse kon vanochtend niet aangeven of zijn cliënt gehoor zal geven aan de oproep van de regering om zich te melden bij HROOIT, of dat hij op het aanbod zal ingaan. Wel kon hij aangeven dat hij samen met Daal, de brief van de minister aan het bestuderen is en dat hoogstwaarschijnlijk een gang naar de rechter zal worden gemaakt om duidelijkheid te krijgen over de gang van zaken. “Feit is en blijft dat het mijn cliënt, sinds januari van dit jaar, toen hij een zaak tegen de minister won, is belet om zijn werkzaamheden uit te voeren.”
