Directors of government NV's appointed for indefinite period of time

WILLEMSTAD - Minister Charles Cooper (Traffic, Transport and Regional Planning, MAN) confirms that the contracts of directors of corporations and institutions from the government are concluded for an indefinite period of time.

In first instance, the cabinet departed from contracts for five years at the most, however, according to Cooper, the government abandoned this for several reasons.Upon the installation of the Schotte-cabinet, the government emphasized that a director of a government nv would qualify for a contract for an indefinite period of time. The contracts would be concluded for five years at the most, while various evaluation moments would be included in the contracts. However, according to Cooper, the government abandoned this because it involved a lot of snags. Cooper points out that if a Board of Commissioners finds out that a director is not functioning properly; it’ll cost a bundle to terminate a five-year contract. The government wanting directors of government nv’s to have the same rights as other employees of the company also played a role, according to Cooper.

“In that case, these employees also get a contract for an indefinite period of time. A director now receives a contract and his/her functioning is evaluated after one year. In the consecutive years, the director concludes a Performance Management Agreement with the Board of Commissioner or the Supervisory Council so the functioning of the director is evaluated every year based on specific factors.”

According to the Minister, the new guidelines have already become effective. The first person to fall under the new guidelines is Darick Jonis, the new director of utility company Aqualectra. The new guidelines will also apply for the new contract of Riles Paulina, the current director of Bus Company Curaçao.
