Judge to give decision on Water’s Edge case 14 December

PHILIPSBURG - A case involving an injunction brought against the Minister of Public Works VROMI by Jerry Speetjens of Water's Edge was heard in court yesterday.

A few days before the change of government (18 May), then-Minister of Public Works Theo Heyliger signed an agreement to allocate 2,000 square metres of water rights at Water's Edge, home to Lee's Restaurant and Roadside Grill in Simpson Bay. Restaurant owner Lee Halley also uses that area for a charter boat service.
 
However, current Minister of VROMI William Marlin has refused to sign the relevant deed.
 
Marlin explained to the Judge at yesterday's hearing that justice would not be served to Halley if he signed the deed.
 
Lee's Restaurant, a family-owned business, has been in operation for many years and "Halley is simply requesting a piece of land to continue his family business," Minister Marlin told the Judge.
He also referred to a gentleman's agreement that had been made to give Halley one-third of the piece of land and water rights. He said that even if his decision not to sign the deed was not correct legally, for him it was morally the right thing to do.
 
The Judge will render his decision on 14 December.
