Musician gets 12 months for sexual abuse of child

PHILIPSBURG--A fifty-year-old musician was sentenced to twelve months Thursday for having committed lewd acts on an eleven-year-old girl.
The Prosecutor's Office had requested this penalty for Eliseo Calcano Galcia, because he had sexually abused a minor, and had been in possession of a hunting rifle and a handgun. Both crimes were committed between January 1 and April 4.
The court found it proven the man had lured the girl into his house under the pretext of giving her music lessons and making her a "star." Instead, he had committed various lewd acts, such as kissing the girl's neck and touching her breasts.
He also allegedly threatened to kill her mother and sister if she ever informed them about what had transpired. In making his argument, he had shown his firearms and even made the girl fire a shot at the wall.
In ruling, Judge Tamara Tijhuis said this was a "refined way" to force the girl to comply with the defendant's lewd behaviour.
The girl told the police she had visited the man about fifteen times. He also came to her house about five times.
Judge Tijhuis dismissed claims that Calcano Galcia had been suffering from the so-called Peter Pan syndrome and would only have had the best of intentions. However, according to the judge, there were no indications the defendant would not have had any sexual intentions. He had acted against the "social-ethical norm" in getting involved with the girl, the judge said in considering sexual abuse proven.
The defendant violated the girl's physical integrity and only had an eye for his own lusts. In doing so, he most likely had a negative influence on the girl's normal and healthy development, the Judge stated.
