One parent can now request joint custody

PHILIPSBURG--One parent can now apply to the court to seek joint custody of a child upon a divorce or in the case of a child born out of wedlock.
Parliament approved this amendment to the Civil Code Book I on Tuesday afternoon and the change will be published soon.
The amendment allows for joint custody to be granted by the court unless this is deemed not in the best interest of the child.
Justice Minister Roland Duncan explained that the Supreme Court in The Hague had ruled in 2008 that the amendment to the Civil Code made in 2001 that called for both parents to file for joint custody was in conflict with the European Union (EU) Treaty on Human Rights. That ruling led to Tuesday's amendment which also further modernises the Civil Code and brings the law up to date with jurisprudence.
